CODE OF ETHICS
Professional Obligations
The Institute of Chartered Technical Practitioners of Canada
Any Code of Ethics is a basic format that lays down principles by which "Humanity treats Humanity" and follows the "Golden Rule" of "Treating others as one would expect others to treat oneself." Basically-"Man's Humanity to Man."
The Code of Ethics of the Institute of Chartered Technical Practitioners of Canada (ICTPC) contains the basic tenets that guide the conduct of the Members of the Institute and impose certain duties on all of its Members. Through strict adherence to the ICTPC Code of Ethics, the Institute's Members will uphold and advance the integrity, honour and dignity of this Institute throughout Canada. The following is the Code of Ethics of the ICTPC :
Integrity of Membership of the ICTPC
1). Members shall not by word, by deed or in writing, deliberately and/or maliciously injure the reputation of the ICTPC or its members.
2). Members shall consider that the business of the ICTPC is vital to the success of the ICTPC, whether of a business and/or technical nature. They shall always be aware that they have a duty to safeguard this information. They must keep it fully confidential and only use it when necessary and with the permission of the Executive Board of Directors of the Institute.
3). Members shall agree to and sign a document by which they affirm that they understand and agree that all documents, photographs and all contents of the Journal, website pages, technical articles, meeting minutes and any other documents related to the operation of ICTPC are the copyright of the ICTPC and remain at all times the intellectual property of ICTPC. Duplication by any means, including without limitation photocopying, photographing, scanning or other methods of replicating these afore mentioned documents and any other documents related to the operation of the ICTPC by a Member or any other party is strictly forbidden without the prior written consent of the Executive Board of the ICTPC. Such consent to be reasonably considered and may be withheld at the sole discretion of the Executive Board of Directors of the ICTPC.
Public Safety & the Professional Engineers' Act of Canada.
4). Members shall protect the interests of their clients, employers and the general public. Where Canadian Federal, Provincial and Local laws, codes or statutes specifically state that a Licensed Professional Engineer is required to review and/or perform the work, then the seal of that Professional Engineer directly responsible for the work shall govern, thus ensuring public safety and welfare. Members shall take appropriate action and notify the proper authorities regarding any violation of safety, or possible risk to the public, based on the most current Canadian laws, codes or statutes.
5). Members shall proffer an opinion on a project or design, only when requested to do so by an employer or a client. Members must carefully analyze the project or design before proffering their opinion. In instances where the projects or designs involves "Public Safety," the member must clearly state that their opinion is only given as an "opinion based on the member's education, work experience and expertise." The member must then direct the employer or client to a Licensed Professional Engineer whose opinion on the project or design shall govern.
6) Members shall refrain from using any designations that incorporates any of the official marks/designations of any of the regulating/licensing engineering bodies in Canada that would breach the Professional Engineer's Act and the Institute's Code of Ethics unless such a member is licensed by the relevant licensing body.
7) Members shall not, for any purpose, deliberately misrepresent their education, work experience, qualifications, certifications, licenses, and/or unique abilities or lay claim to any other qualifications they do not possess.
8) Members shall undertake only that work for which they are fully qualified, by virtue of their education, training, and work experience and shall not in any way portray themselves as Licensed Professional Engineers.
9). Where Canadian Federal, Provincial, and Local laws, or statutes state that a Licensed Professional Engineer is required to design, perform, review, stamp, and or supervise the work, members shall inform their employer or client(s) of this lawful requirement.
False or Exaggerated Claims
10). Members shall not make exaggerated or unsubstantiated statements concerning any research, project, design, concepts, ideas, drawings, and or documentation in which they are or have been involved either directly or indirectly.
Conflict of Interest
11). Members shall avoid situations where their loyalties may be divided between the interests of an employer or a client and the member's self-interest. Members shall therefore strive to avoid any appearance of conflict of interest. Members shall immediately disclose to an employer or client any real conflict of interest or any potential conflict of interest upon the realization by the member that such conflict exists or could exist in the relationship as employee or contractor/consultant.
Continued Advancement of Education and Experience.
12). Members shall augment their knowledge and expertise through a continuous process of "education upgrading" that will sustain an advanced level of technical proficiency within the discipline of each member's expertise.
Integrity of Employment
13). Members shall maintain relationships with employers or clients based on the quality and value of each member's service. 14). Members shall always return full value for the remuneration received from an employer or client. 15). Members shall always conduct their business with uncompromising integrity. 16). Members shall adhere to the highest standards of business ethics and comply with all current applicable codes and laws. 17). Members shall not personally use - directly or indirectly - confidential information of an employer or client other than for the purpose for which the confidential information was provided. 18). Members shall not disclose - directly or indirectly - confidential information of an employer or client other than for the purpose for which the confidential information was provided, unless directed to do so by a court of competent jurisdiction or other government authority and is thus required to do so by law. 19). Members shall at all times safeguard an employer's or client's assets, whether tangible and/or intangible in nature. Each member has the "privilege" of using an employer or client's assets only for the legitimate business purposes of the owner. Each member has the duty to reasonably protect these assets from loss, illegal and improper use. 20). Members shall at all times protect and safeguard the interests of their employer or client(s) and the general public in accordance with all Canadian Acts and Laws of Parliament and also those of the Provinces, and Territories in which the Work is to be established. Careful consideration shall also be shown to any by-laws or special conditions laid down by the Cities, Towns and Townships etc so that the employer, client(s) or end user is not in breach of any such condition. 21). Members shall always act fairly, legally and with uncompromising integrity. 22). Members shall not directly or indirectly by malice or false accusation injure the professional reputation, business prospects, practice or employment of another member of the ICTPC or colleague. 23). Members shall not indiscriminately criticize another person's work or their responsibilities and or their methods or the processes used 24) Members, who in their opinion and based upon their expertise and work experience become aware (cognizant) of unsafe designs, inaccurate reports, inaccurate calculations, inaccurate drawings, and/or unsafe working conditions, shall immediately report this anomaly to the appropriate authority. 25). Members shall be accountable to an employer or client(s) for their individual work. They shall validate to an employer or client that the work is completed in an accurate and professional manner using sound technical / engineering principles and practices. 26). Members must validate their work in order to assure an employer or client that the completed work is in accordance with the all technical specifications and requirements provided by an employer or client (or the customer of an employer or client). The validation process can, in some circumstances, be enhanced using appropriate tools that verify the results of the work that has been completed and that the net result meets the specifications and requirements of the employer or client. Members shall not rely completely on the output of the "tool" (e.g. engineering software program - refer to Guidelines for the Proper use of Software when considering software assisted design tools) used and may only use the "output" of the tool as but one verification methodology. The "output" must be verified (as much as possible) by using other more "tried and tested" methods. 27). Members must also ensure that the completed work is in accordance with applicable federal, provincial, local, by-laws, or industry based codes or standards published by the various regulating bodies. Violations of the ICTPC's Code of Ethics 28). Members found to be in breach of the ICTPC's "Code of Ethics" will be subject to disciplinary action by ICTPC's Disciplinary Board. At the sole discretion of ICTPC's Disciplinary Board, disciplinary action will be taken against a member found to be in violation and may result in him/her being required to successfully complete one or more of the following options within a reasonable and agreed time period. 1) A member shall be required to successfully complete the ICTPC's written ethics examination, and/or2) A member shall be required to complete a technical report that demonstrates to the ICTPC Disciplinary Board that the member possesses the core competencies required to retain Membership in the Institute, and/or 3) A member may be required to attend a meeting with the Institute's Disciplinary Board at which time the member may be required to successfully complete an oral examination or provide an oral response to questions posed by the Disciplinary Board members. 4) A member whose membership is terminated and or expired shall return all property of ICTPC but not limited to their membership certificates and confidential documentation. In the event of ICTPC's Disciplinary Board instituting disciplinary action on a member, that member's designation with ICTPC may be revoked. This revocation may be a temporary action and to be at the sole discretion of the Disciplinary Board. The member's designation will only be restored when ALL the selected options have been successfully completed by that member within the agreed time period and that the "Majority" of the Disciplinary Board Members are satisfied that that member is no longer in violation of the Institute's Code of Ethics.
Professional Canons
The canons are abbreviations of the paragraphs written in the Main Code of Ethics shown above, and are written here as simple "REMINDERS" of their numerical counterpart written in the Code of Ethics. The "Ethical Requirement" as stated in the "FULL" paragraphs takes precedence over these canons in all instances.
1) Members shall not maliciously injure the reputation of the ICTPC.
2) Members must safeguard and keep fully confidential all ICTPC business.
3) Members shall agree that their membership certificates, membership card, and all documentation pertaining to the ICTPC remains at all times the intellectual property of ICTPC.
4) Members shall protect the interests of their clients, employers and the general public
5) Members must clearly state that their opinion, when requested, is based entirely on their education, experience and expertise.
6) Members shall never wrongfully use any official mark or designation of any of the regulating/licensing engineering bodies in Canada
7) Members shall not deliberately misrepresent their education, work experience, licenses, and or qualifications and/or lay claim to qualifications they do not possess.
8) Members shall undertake only that work for which they are qualified by virtue of their education, training, and experience.
9) Members must inform their employer(s) or Client(s) when by law, requires the services of a Licensed Professional Engineer.
10) Members shall not make exaggerated statements concerning their work.
11) Members shall strive to avoid any appearance of a conflict of interest.
12) Members shall augment their knowledge and expertise through a continuous process of 'further education.'
13) Members shall maintain relationships based on the quality of service.

17) Members shall not wrongfully use confidential information entrusted to them by an employer or client.
18) Members shall not disclose confidential information of an employer or client(s) -unless required to do so by law.
19) Members shall safeguard the assets of their employers or clients.
20) Members shall safeguard the interests of their employer or client(s).
21) Members shall act fairly, legally and with uncompromising integrity.
22) Members shall not injure the professional reputation, prospects, practice or employment of another member of the ICTPC, or colleague. Members shall not indiscriminately criticize another person's work.
23) Members shall not indiscriminately criticize another person's work.
24) Members must report any dangerous or unsafe conditions, actions, machines or designs or any other anomalies.
25) Members shall be fully accountable for their work.
26) Members shall fully validate the results of any calculations, designs or forecasts, being by computerized or by other means, by using other "tried and tested" methods.
27) Members must also ensure that their completed work is in accordance with applicable codes of the regulating or governing bodies.
All members must follow and adhere to the Institute of Chartered Technical Practitioners of Canada's Code Of Ethics. Any infraction of the ICTPC's Code of Ethics or a breach of the Professional Engineer's Act will result in severe penalties and possible litigations. In support of the ICTPC's Code of Ethics, all members of the ICTPC, without exceptions, must be cognizant of the following:
1) The ownership of the Membership Certificate2) Use of Software Design Tools 3) The Guidelines to the reporting of Unsafe Incidents Any form of misrepresentation, professional misconduct, unethical behavior, negligence and incompetence will not be tolerated. All members MUST perform their duties within their specified/specific field of knowledge, expertise, education and practice. Please refer to Guidelines to Professional Practice |
